Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which

• in case of a service contract (subscriptions): the contract was concluded,
• in case of a sale of goods (promotional apparel): you or a third party named by you who is not the carrier took possession of the goods,
• in case of delivery in several partial shipments: the last partial shipment was taken into possession.

To exercise your right of withdrawal, you must inform us

by an unequivocal statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a delivery type other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.

For deliveries of goods, we may withhold reimbursement until we have received the goods back or you have provided evidence of having sent them back, whichever is earliest. You must return the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods.

You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion / early expiry

No right of withdrawal exists for contracts to supply goods made to consumer specifications or clearly personalised (§ 312g(2) no. 1 BGB) — this applies in particular to promotional apparel with individual QR-code printing.

The right of withdrawal expires early for contracts to supply digital content not on a tangible medium (in particular QR-code packs, web business cards, vanity-slug purchases) where ViveQode has begun performance after you

1. have given express consent for ViveQode to begin performance before the withdrawal period ends, and
2. have acknowledged that by giving this consent you lose your right of withdrawal once performance begins.

This consent is confirmed as a separate checkbox during the checkout process.

Note on subscriptions (service contracts)

If you request that the services begin during the withdrawal period, you must pay us an amount that is proportional to the services already provided up to the time you inform us of your withdrawal, compared to the total scope of services agreed in the contract.
